Kansas AG’s harassment of an abortion provider fails again

Charges against George Tiller, brought by notorious anti-choice Attorney General Phil Kline (yes, the same guy who, as part of his anti-choice crusade, subpoenaed the private medical records of dozens of women and girls who had terminated their pregnancies), have been dropped — not only because they were entirely unsubstantiated, but because the DA herself requested their dismissal. And because Kline lacked the legal authority to file them in the first place.

Kline was ousted in the most recent election, and is using his final weeks in office to continue his persecution of Kansas abortion providers. The fact that he’s targeting Tiller isn’t surprising, as Tiller is routinely harassed by the anti-choice movement (he’s a favorite target of Operation Rescue), and has been a repeated victim of anti-choice terrorism. His clinic has been bombed, and he has been shot in both arms. A simple google search will reveal anti-choice sites that post pictures of his home, directions to his house, and give his personal address. Anti-choice groups have filed repeated unsubstantiated charges against him, none of which stick. But it’s certainly interesting (and unfortunately not surprising) to see a state official jump on board with the zealots who stalk, harass, and intimidate Dr. Tiller, and who often resort to violence.

Thankfully, Kline will be out in just a few days, and his Democratic replacement with undoubtedly be better.

  1. Wait, Kline thought that a 10-year-old child should have been forced to continue her pregnancy, even though it probably would have permanently ruined her health?

    What the fuck is wrong with these people?

  2. According to one of our local news stations, KWCH.com: “Tuesday, Kline filed a motion for “emergency reconsideration” and the judge scheduled a hearing for Wednesday at 2 p.m. to hear arguments in the case.

    Besides Kline, the Sedgwick County District Attorney, an attorney for Dr. Tiller and Attorney General-Elect Paul Morrison could all take part in tomorrow’s hearing.”

    Also, Kline has been appointed to replace Morrison as the Johnson County DA. *facepalms* The voters kick him out and the Republicans invite him right back in. Isn’t that lovely?

  3. FUCK. I live in Johnson County, Kansas. Johnson County is considered a hugely important part of the vote. We voted that mother fucker out of office, but the Rethuglicans go ahead and appoint him another big position of power. Keep in mind this is the same guy who thinks that if a 10 year old boy and a 10 year old girl are caught ‘playing doctor,’ they should both have records of simultaneously being sex offenders and sexual assault victims. You know, like in Utah.

    Fuck you, Phil Kline. And fuck you, my sister Alex, for voting for the son of a bitch. UGH!

    BTW, whatever happened with his demand for access to all abortion patients’ records?

What apparently bugged him was not the fact that a ten-year-old girl had been impregnated, it was the fact that she wanted an abortion rather than all the trauma—some of it potentially fatal—that carrying to term would exposed her. Aside from obviously being raped, of course. That’s ole Phill, just out there protecting the children.

  6. According to the local news, a judge denied Kline again Wednesday afternoon, but Kline apparently wants to appoint a special prosecutor to pursue the charges once he’s out of office.

    Personally, I think he’s really starting to tick off the Sedgwick District Attorney, Nola Foulston. Not a smart move, that.

    He put forth two rationales for seeking the records — one, that he was just trying to sniff out unreported sex crimes (i.e., child rape) and two, that he wanted to make sure that Tiller’s clinic was complying with the requirements for late-term abortions.

    Both rationales were ill-served by his requests. For the first one, he was asking for the records, iirc, of all abortions performed in the second or third trimesters, regardless of age. Plus, if what you want is to root out unreported child rape, you could start by asking for the redacted records of girls under a certain age to see if the numbers of reports from abortion clinics of underage girls getting abortions matches the numbers of redacted records you have. Then you continue by examining birth certificates of children born to very young mothers and make sure that the hospitals are reporting that.

    The other thing — making sure that the women seeking abortions are actually truly qualified under state law– again, could have been dealt with by seeking redacted records in a narrowly-tailored request.

  9. Oh man, I just heard that Kline HAS appointed a special prosecutor. And that Nola Foulston, the DA, told him no special prosecutor was welcome in her jurisdiction. To which Kline replied, the special prosecutor was staying.

    This should be fun. And by fun, I mean full of drama. *sighs*

  10. This guy Phil should be shot in the arms and have his own house bombed just to see how he’d like to live the life of someone he’s prosecueting.
    What an asshole, someone should go threw his medical records and make public any embarrassing trivial little facts.
    Wonder if he uses viagra? *eye roll*

    People like him who want to know all the secretive and juciy details of other people’s lives usually have some of their own skeletons hidding in the closet.

  11. You guys seem to be ignorant or forgetful that Kline actually has physical papers in his possession. And he carried them to an interview with Bill O’Reilly on national TV. He took the records out of state and wanted to read details aloud on national TV.
