  1. Does this lawsuit seem odd to anyone else?

    So…these states cannot regulate emissions on their own? Instead, they’re trying to force the federal government to do the regulating for them.

    That seems like an odd way to go about this. Unless, of course, these states are really just trying to impose on the rest of the states. How nosy of them.

    Incidentally, I think they’re going to have trouble showing that the Clean Air Act is being mis-applied. From the CAA sec. 101(a)(3):

    …that air pollution prevention (that is, the reduction or
    elimination, through any measures, of the amount of pollutants
    produced or created at the source) and air pollution control at
    its source is the primary responsibility of States and local
    governments…

  2. Air travels across state lines.

    There are a lot of dead lakes in New York State and New England due to acid rain caused by the emissions from plants in Michigan and Ohio. New York can regulate emissions within its own borders, but that doesn’t do a damn thing when a plant in another state sends particulate matter and carbon dioxide downwind. So, yes, they need the EPA to act.

  3. Sweden is suffering serious enviromental problems due to pollution eminating from germany, the UK, france and most of the rest of europe.

    Did you think air and water currents payed attention to international and national borders or something?
